EXECUTIVE ORDER MJF 01-9

Interstate 49 South Project Task Force

WHEREAS, Executive Order No. MJF 97-38, issued on September 18, 1997, established the Interstate 49 South Project Task Force (hereafter "Task Force");

WHEREAS, Executive Order No. MJF 98-10, issued on March 11, 1998, extended the time period for the Task Force to submit its report to the governor; Executive Order No. MJF 98-34,1 issued on July 14, 1998, amended the membership description of the Task Force; and Executive Order No. MJF 99-9, issued on March 16, 1999, added an additional secondary duty for the Task Force; and

WHEREAS, it is necessary to amend Executive Order No. MJF 97-38, as amended by Executive Order Nos. MJF 98-10 and MJF 99-9,2 in order to amend its membership provision;

NOW THEREFORE I, M.J. "MIKE" FOSTER, JR., Governor of the state of Louisiana, by virtue of the authority vested by the Constitution and laws of the state of Louisiana, do hereby order and direct as follows:

SECTION 1: Section 4 of Executive Order No. MJF 97-383 is amended as follows:

The Task Force shall be composed of a maximum of twenty-five (25) members who, unless otherwise specified, shall be appointed by the governor and serve at his pleasure. The membership of the Task Force shall be selected as follows:

A. The governor, or the governor's designee;

B. The secretary of the Department of Transportation and Development, or the secretary's designee;

C. The chair of the House Transportation, Highways, and Public Works Committee, or the chair's designee;

D. The chair of the Senate Transportation, Highways, and Public Works Committee, or the chair's designee;

E. The Federal Highway Administrator for the state of Louisiana, or the Federal Highway Administrator's designee;

F. Representatives from communities located along the span of U.S. 90 between the Westbank Expressway in New Orleans and I-10 in Lafayette;

G. Representatives of businesses in South Louisiana;

H. Representatives of the Lafayette, Houma, and New Orleans Metropolitan Planning Organizations;

I. A representative of the farming community by a resident of Louisiana whose principal business is farming; and

J. Two (2) at-large members.

SECTION 2: Executive Order No. MJF 98-34, issued on July 14, 1998, is terminated and rescinded.

SECTION 3: All other sections, subsections, and paragraphs of Executive Order No. MJF 97-38, as amended by Executive Order Nos. MJF 98-10 and MJF 99-9, shall remain in full force and effect.

SECTION 4: The provisions of this Order are effective upon signature and shall remain in effect until amended, modified, terminated, or rescinded by the governor, or terminated by operation of law.

IN WITNESS WHEREOF, I have set my hand officially and caused to be affixed the Great Seal of the state of Louisiana, at the capitol, in the city of Baton Rouge, on this 20th day of February, 2001.

1 Executive Order No. MJF 98-29, signed on May 26, 1998, also altered the composition of the Task Force. However, that Order was terminated and rescinded by Executive Order No. MJF 99-9. Executive Order No. MJF 98-34 is terminated and rescinded in Section 2 of this Order.
