20-906 District Attorneys and Assistant District Attorneys

Program Authorization: R.S. 16:10, 16:11, R.S. 16:17

PROGRAM DESCRIPTION

This program provides full funding for 41 District Attorneys and 485 Assistant District Attorneys at the current year rates as well as estimated Medicare and retirement requirements for participants of this program. State statute provides an annual state salary of $50,000 per district attorney and $30,000 per statutorily authorized assistant district attorney. Additionally, funding is provided for 58 statutorily authorized victims assistance coordinators statewide. This added funding was initiated in the 1997 Fiscal Year. State statute provides an annual state salary up to $25,000 per statutorily authorized victims assistance coordinator - subject to funding level. An additional 25 Assistant District Attorneys are recommended for Fiscal Year 2000 to handle workload demands.

This agency's recommended appropriation does not include any funds for short-term debt.

This agency does not have any long-term debt for Fiscal Year 1999-2000.

SOURCE OF FUNDING

The sources of funding for this program are State General Fund direct and Video Draw Poker Device Fund. Louisiana Revised Statute (R.S.) 33:4862.12 created the Video Draw Poker Device Fund and provides for its uses. R.S. 33:4862.12 C(1)(a) provides that of the twenty-five percent of the revenues from video draw poker, "sufficient funds shall be deposited in the state treasury to provide district attorneys and assistant district attorneys an increased compensation which may be provided to them by any law enacted in the 1992 Regular Session, not to exceed five million, four hundred thousand dollars." (1992 Regular Session legislation increased district attorney's state salary from $35,533 to $50,000, and assistant district attorney's state salary from $18,951 to $30,000. The dedication from video draw poker revenue has in part paid for these increases.) (Per R.S. 39:32B.(8), see table below for a listing of expenditures out of each statutory dedicated fund.)

The total means of financing for this program is recommended at 107.2% of the existing operating budget. It represents 103.5% of the total request ($18,892,757) for this program. Twenty -five (25) additional Assistant District Attorneys statewide are provided for in the total recommended. Additionally funding for the scheduled 27th pay period has been included in the total recommended.

State funding for the 41 statutorily authorized District Attorneys - statewide. Louisiana R.S. 16:10 provides for a $50,000 annual state salary per district attorney plus related benefits. One statutorily authorized district attorney per each of the 41 judicial districts in the state.

State funding for the 58 statutorily authorized Victims Assistance Coordinators - statewide. Louisiana R.S. 16:17 provides for up to $25,000 annual state salary per statutorily authorized victims assistance coordinator plus related benefits - subject to funding level. One statutorily authorized victims assistance coordinator per each of the 41 judicial district in the state; in judicial districts exceeding one hundred thousand persons there shall be one full-time victims assistance coordinator for each one hundred thousand persons or portion thereof which exceeds fifty thousand persons.

State funding for the 485 statutorily authorized Assistant District Attorneys statewide. Louisiana R.S. 16:11 provides for a $30,000 annual state salary per statutorily authorized assistant district attorney plus related benefits. The number of statutorily authorized assistant district attorneys varies per judicial district depending upon workload and population. R.S. 16:51 sets forth the number of assistant district attorneys per judicial district. Additional funding for 25 new Assistant District Attorneys statewide is included in the total recommended bringing the total recommended Assistant District Attorney number for FY 00 to 510 statewide.
