Program Authorization: R.S. 30:2171
PROGRAM DESCRIPTION
The mission of the Waste Services Program is to maintain and enhance the environment of the state in order to promote and protect the health, safety, and welfare of the people of Louisiana. The OWS will pursue efforts to prevent and to remediate contamination of the environment through the proper management of underground storage tanks and solid and hazardous waste facilities. Furthermore, the OWS will unify, coordinate, and implement programs to provide for the most advantageous uses of the resources of the State, considering sound policies regarding economic development. The activities in this program are: Hazardous Waste, Solid Waste, Underground Storage Tanks, Ground Water Protection (formerly under the auspices of Water Resources) and Inactive and Abandoned Sites (formerly under the auspices of the Office of Legal Affairs and Enforcement).
OBJECTIVES AND PERFORMANCE INDICATORS
Unless otherwise indicated, all objectives are to be accomplished during or by the end of FY 1999-2000. Performance indicators are made up of two parts: name and value. The indicator name describes what is being measured. The indicator value is the numeric value or level achieved within a given measurement period. For budgeting purposes, performance indicator values are shown for the prior fiscal year, the current fiscal year, and alternative funding scenarios (continuation budget level and Executive Budget recommendation level) for the ensuing fiscal year (the fiscal year of the budget document).
RESOURCE ALLOCATION FOR THE PROGRAM
SOURCE OF FUNDING
This program is funded with General Fund, Fees and Self-generated Revenues, Statutory Dedications and Federal Funds. Fees and Self-Generated Revenues are derived from the sale of manifest forms, regulations, photocopies, etc. Statutory Dedications are from the Environmental Trust Fund (ETF), the Hazardous Waste Site Cleanup Fund (HWSCF), the Motor Fuels Underground Tank Trust Fund (MFTF), and the Waste Tire Management Fund (WTMF). (Per R.S. 39:32B. (8), see table below for a listing of expenditures out of each statutory dedicated fund.) The ETF revenues consist of all fees assessed pursuant to the authority granted in R.S. 30:2014, R.S. 39:55.2 and any other provisions of the law authorizing the department to assess fees. The HWSCF revenues are derived from the proceeds of the Hazardous Waste Tax and fines and penalties collected from environmental offenders in accordance with R.S. 30:2205. The MFTF revenues consist of payment of fees by owners of underground motor fuels storage tanks in accordance with R.S. 30:2194 and 30:2195. The WTMF consist of fees pursuant to the authority granted in R.S. 30:2418, R.S. 39.55.2 and any other provisions of the law authorizing the department to assess fees. All Statutory Dedication revenues are used only for the purposes for which they are assessed. Federal Funds are from the Resources Conservation and Recovery Act, the Pollution Prevention Act of 1990, the Solid Waste Disposal Act (Section 8001), the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) (Section 104), and the Superfund Amendments and Reauthorization Act of 1986 (SARA).
